There is also the question of what happens when the next administration arrives. A framework built on executive preference rather than durable legislation is inherently reversible, which means the technology industry's celebrated regulatory certainty could evaporate in January 2029. Companies that have structured their compliance programs around federal preemption may find themselves suddenly exposed to a resurgent wave of state laws, potentially stricter than anything currently on the books.

The administration is making a large wager that American AI companies will translate their freedom into global dominance, and that dominance will eventually justify the risks taken along the way. It is possible that bet pays off. It is equally possible that the costs, borne quietly by children, workers, and communities with little political leverage, will only become legible once they are very difficult to reverse.
